Terms and Conditions
RENTAL OF LA TOC VILLA, BAGSHAW ROAD, ST LUCIA
1. Contract of Hire
All bookings are subject to these conditions that are deemed to
have been accepted in full by the hirer and by all persons in the
party.
2. Deposit
A deposit of 50% of the total cost is required to secure any
booking. If the booking is made 4 weeks or less before the hire
commencement date, it must be accompanied by full payment. Payment
can be made by US or UK bank transfer, UK cheque or PayPal. A
damage deposit of USD300 or £200 will be payable at the time of the
final payment: assuming there is no damage this deposit will be
refunded within 10 days of the Villa being vacated.
3. Final Payment
The balance must be paid 4 weeks prior to the hire commencement
date.
4. Cancellation Policy
In the event of cancellations made more than 12 weeks prior to
arrival date 25% of the total is forfeited. Cancellations made
between 12 and 4 weeks prior to arrival date: 50% of total (i.e.
the deposit) is forfeited. Cancellations made less than 4 weeks
prior to arrival date: 100% of the total is forfeited. However, if
a late notice booking can be secured to cover any cancellations,
only 25% will be forfeited and any monies owing will be repaid at
the time the original booking commenced.
5. Alterations and Cancellations by La Toc Villa
In the unlikely event that the Villa becomes unavailable due to
circumstances beyond our control we will offer you a full refund of
monies paid at that time. Any refund is restricted to the Villa
hire costs and we are not liable for any cancellation or
administration charges for travel arrangements etc.
6. Price includes:
Linen, towels (not including beach towels), all utilities
including air conditioning and a maid cleaning service. An initial
stock of soap and toilet paper will be included.
7. Occupancy
You must let us know the number of persons who will occupy the
Villa at the time of booking. If you wish to add further
individuals you may only do so by prior arrangement with us. No
pets are allowed and smoking is not permitted in the Villa.
8. Arrival/Departure
Rental periods are for a minimum of 3 nights. The Villa will be
available for occupation from 4.00pm on the day of arrival and must
be vacated by 11.00am on the day of departure. Earlier and later
departure times may be available with prior arrangement.
9. Damage
Except in the case of normal wear and tear, the hirer will be
responsible for making good any damage to the Villa, contents and
to the swimming pool, which occur due to negligence or
irresponsible behavior on the part of those occupying the property
or their guests. Such damage must be immediately reported to the
manager Joan Paul. Please supervise your children at all times,
especially around the pool and in the garden.
10. Swimming Pool
Use of the swimming pool and children's pool is at your own risk
and please note that the pool is not fenced off. The swimming pool
is shallow and diving is discouraged. Please use 'swimmer' nappies
for infants under three and supervise your children at all times
around the swimming pool. The property owner and management team of
La Toc Villa accept no liability for any death or personal injury
arising from use of or connected with the swimming pool. The
property owner has no liability for any death or personal injury
which results from failure to comply with the above
recommendations
11. Our liability
La Toc Villa is covered by a 'Multirisk' insurance policy.
However, the property owner and management team of La Toc Villa are
not responsible for any personal injury, illness, death, loss or
damage of whatever nature suffered by you or by any member of your
party during the booking period, taxi transfers or thereafter. This
includes injury or harm while using the swimming pool.
12. Keys, Directions and Management
The management team will send directions to the Villa on
confirmation of your booking (unless you have booked a taxi
transfer). When you arrive, one of the management team will give
you a set of keys, show you around the accommodation and explain
how everything works. A member of the management team will be
contactable throughout your stay. Please return the keys on
departure.
13. Force Majeur
We regret that we cannot accept liability or pay any compensation
where the performance or prompt performance of our contractual
obligations is prevented or affected by 'force majeur'. In these
Terms and Conditions, 'force majeur' means any event which we or
the supplier of the service(s) in question could not, even with due
care, foresee or avoid. Such events may include, but are not
limited to, war, threat of war, civil commotion or strife,
hostilities, strikes or other industrial disputes, natural
disasters, fire, acts of God, terrorist activities, quarantine,
epidemics, weather conditions, closure of airports, water
shortages, power failure, government action or other events outside
our control.
14. Insurance
The Villa rental cost does not include personal insurance cover.
It is strongly recommended that you take out cancellation
insurance, personal accident and medical insurance for the period
of your holiday. If you wish to engage in surfing or other water
sports please check that you are covered by your own insurance
policy.
